Your rights

Young people have rights when it comes to dealing with the police; best results happen if you stay calm and polite.

Your Rights in Victoria

  • You don't have to answer any questions from the police without a lawyer.
  • Police must provide an interpreter if you ask.
  • You only have to go with the police if you are under arrest. Tell someone where they are taking you.
  • You have the right to phone a lawyer, relative or friend before you are interviewed.
  • If you're under 18, the police must arrange a parent/guardian or independent adult to be present at the interview.
  • You have the right to refuse to have your photo taken and can refuse to be in an identification line up.
  • You have the right to refuse to give a forensic sample.
  • You have the right to see a doctor urgently if you are hurt.

Police have rights too 

  • If asked, you must give your name and address to the police.
  • If you are over 18 years you have to give your fingerprints. If you are under 18 years old a parent/guardian must be present.
  • Police can search you, your bag or your car if they suspect that they will find illegal drugs, weapons or stolen goods, or to gather evidence.
